H.R. 543: The Blue Water Navy Vietnam Veterans Act

Agent Orange, used as a defoliant by the United States in Vietnam, has been linked to cancer and various nerve, respiratory and digestive disorders, among other ailments. Those service persons with presumed exposure are entitled to certain health benefits.

The legislation would grant presumptive Agent Orange exposure status to U.S. service members — primarily those serving in the Navy — who served in the so-called territorial waters, up to 12 miles off the shore in Vietnam.

S. 734: Repealing the SBP-DIC Offset

This bill would repeal the requirement for reduction of survivor annuities under the Survivor Benefit Plan to offset the receipt of survivors Dependency and Indemnity Compensation. This bill is in accordance with a longstanding DAV resolution, passed each year by the delegates to our National Convention. H.Res. 138: Expressing support for designation of a “Welcome Home Vietnam Veterans Day”.

Our Vietnam veterans came home not to parades but the wrath of a country that was in the midst of great civil unrest. As a result many veterans were mistreated by their countrymen. Our country can never make up for that betrayal and therefore forever owes our Vietnam veterans. Although designating a day each year to 'Welcome Home' Vietnam veterans may never heal the wound; it is a step in the right direction. Perhaps it will be a reminder so that this nation never again turns it's back on our 'sons and daughter's when they come home from war.

This country has an obligation to it's veterans. Recent evidence shows that the water at Camp Lejeune was contaminated much earlier than was originally thought. Modifying title 38 is merely a formality but an important one for our veterans and their families in need of hospital care and medical services related to exposure to contaminated water at Camp Lejeune.

The Secretary of Veterans Affairs should most definitely create a Registry for veterans who were stationed at Fort McClellan, Alabama. We hear often from veterans who are ill and were stationed at Fort McClellan looking for answers and help. A registry would be an important step in helping these veterans get the help and answers they need.

Agent Orange Legacy supports H.R. 164 ("to permit veterans who have a service-connected, permanent disability rated as total to travel on". This bill, if passed, would improve the quality of lives of our disabled veterans who have already sacrificed so much for our country. Many our veterans who are service-connected, permanent disability rated as total have limited resources and must struggle with, in most cases, daunting health concerns. Allowing them to travel on military aircraft in the same manner and to the same extent as retired members of the Armed Forces entitled to such travel, when space is available, would be one way to honor these veterans.

Ensuring Needed Health Care For Veterans' Children With Spina Bifida

At this point in time Spina Bifida is the only birth defect recognized by the VA in the children of male Vietnam veterans exposed to Agent Orange.

Since 2007 we have found more and more of the adult children of Vietnam veterans exposed to Agent Orange who are sick and suffering. Even today nothing is being done to meet the needs of these adult children. Their suffering not yet recognized by the VA.

There are only 1,200 of the most severely disabled children eligible for care under the Spina Bifida Health Care Program. Yet the VA continues to fail to provide Comprehensive Health Care to these 1,200 adult children eligible for in-home care under the law (38 USC §1803).

Support our veterans and their families and urge Congress to demand the VA follow the law and provide complete care to Spina Bifida children.

S. 175: A bill to amend the Federal Insecticide, Fungicide, and Rodenticide Act to improve the use of certain registered pesticides.

FIFRA and CWA are complementary laws and the CWA permit process only affects a relatively small number of pesticide applications. The two statutes have fundamentally different standards and methods in determining whether a pesticide will have unreasonable adverse effects on the environment and/or human health. CWA has a “zero discharge” standard, meaning any amount of discharge, no matter how small, without a permit, constitutes a violation of the CWA. Risk assessment-based standards under FIFRA, on the other hand, are weaker.

On December 5th, Representative Jerrold Nadler (D-NY) introduced the “Ban Toxic Dispersants Act” (H.R. 3562), which would amend the Federal Water Pollution Control Act to establish new procedures for the use of chemical dispersants in oil cleanup efforts. The bill would require the Environmental Protection Agency (EPA) to carry out a new rulemaking procedure to establish baseline levels of toxicity and effectiveness, taking into account a study of the acute and chronic risks posed by the use of dispersants. The EPA would be required to determine whether it is safe to use these dispersants before granting any approvals. The bill includes a temporary moratorium on the use of dispersants until the rulemaking and study ensuring their safety is complete. The EPA, however, could grant conditional approvals if it determines that there will be no negative impact on human health or the environment. The bill would also require that the ingredients and the location of applied dispersants be made available to the public online.

Oppose Amendment to MilCon/VA Spending Bill (HR 2055) Senator Coburn (Ok.) has filed an amendment (#564) to the Military Construction/ Veterans Affairs Appropriations bill (HR 2055) that will require a "causal relationship" for presumption for service connection for diseases associated with Agent Orange exposure that will significantly restrict benefits to Vietnam veterans. Vietnam veterans are presumed to be exposed to Agent Orange if they have certain conditions or diseases after the VA determines that a positive association exists between the exposure and the occurrence of the disease. Congress chose this mechanism because it is nearly impossible for Vietnam veterans to prove that exposure to Agent Orange caused their disease. Requiring a "causal relationship" would essentially mean that VA benefits for Agent Orange exposure would be out of reach for many Vietnam veterans that were exposed to the Agent Orange herbicide.
