Guidelines on Acceptable Language

POPVOX is a soapbox to quantify and amplify your voice on matters before the U.S. Congress. That said, it is not a forum for general political discussion and we encourage the use of a civil tone. While we hope we will not have to interfere with comments posted on the website, the following is a summary of our policy on acceptable language:

Your comments here must pertain to legislation and must:

  • not be profane, harassing, or threatening to others
  • not create a risk of harm to anyone
  • not include the personal, private information of others
  • not contain information that would be illegal for you to distribute
  • not otherwise violate the rights of others

If a comment does not satisfy these standards, we will remove the comment from the legislative reports that other users see, and we will notify the commenter of our decision. The comment will continue to be counted toward the aggregate public sentiment statistics on POPVOX, and we will deliver the message to Congress provided it would not be unlawful for us to do so. If the user chooses to revise the comment so that it satisfies these standards, then the comment will be displayed. POPVOX reserves the right to decide, in its sole discretion, whether or not a comment satisfies the standards.

What We Know About You

How do you know that POPVOX takes your privacy seriously? It’s not because we have a privacy policy. It’s because we go the extra mile to show you as honestly and transparently as possible what we do with the personal information you give us.

The following is a brief explanation about how we use the information we collect from you. When you are logged in, the Privacy Report lists the information we have on file about YOU.

Personal Information How We Use It
Your Email Address Your email address is shared with your Members of Congress when you weigh in on legislation, and sometimes with organizations that referred you to POPVOX if you gave us your permission to do so (see Who Referred You). It is not shown publicly. We use your email address to send you news and account information.
Your Screen Name Your screen name is how you are known to other users on POPVOX. It shows up next to each of your public comments on legislation.
Your Name, Address, and Phone Number Your name, physical address, and phone number are shared with your Members of Congress when you weigh in on legislation, and sometimes with organizations that referred you to POPVOX if you gave us your permission to do so (see Who Referred You), but no one else. Congressional offices require this information when accepting the letters we deliver on your behalf. When you move, we keep your past addresses on file so we know what Congressional district you were in when you left comments there.
Your Comments and Your Congressional District When you leave a comment on legislation, it is shown publicly on POPVOX along with your screen name and your state and congressional district, and it is delivered to your Members of Congress. Your comment is only identified with your real name and physical address when it is sent to your Members of Congress, and also sometimes it is shared with organizations that referred you to POPVOX if you gave us your permission to do so (see Who Referred You). Your comments are listed on your POPVOX home page.

We also use your comments to suggest other bills you may be interested in.

We maintain a record of all delivered correspondence to your Members of Congress, even if you subsequently delete your comment, in order to protect the integrity of our relationship with Members of Congress. These records are deleted shortly after the end of the two-year Congressional session in which they were sent.
Who Referred You When you leave a comment on legislation, we keep note of how you got here (normally that means from the website of an advocacy organization) and include that information when we deliver your comment to your Members of Congress.
Additionally, when you take action on an action page that has been customized by an organization or through the POPVOX Write Congress widget hosted by an organization, we may provide the organization with the information you enter — in either case, we ask your permission or let you know at the time you are filling out the information.
Your Bookmark Settings You can choose to bookmark bills and exclude bills from suggestions we make about what you might be interested in. We use these settings to customize suggestions we have for you and, in aggregate, for others. We don’t tell anyone what bills you weighed in on, except as explained above.
Your Appreciations You can appreciate the comments others leave on POPVOX. We don’t currently share your appreciations with anyone and only use appreciations in aggregate to let other users find the most appreciated comments. However, we will soon be showing what comments you have appreciated in a way that is tied to your public screen name, but not your real name or address.
Other Information How We Use It
Advertisements Viewed We keep a record for a short period of time of the advertisements that we have shown to you in order to avoid showing you the same advertisements repeatedly. This information is stored in a cookie separately from your account. It is not shared with advertisers.
Log Files We also keep industry-standard log files that record certain non-personal information including your IP address, the URL of the page you are visiting, your browser type, and referring pages. This information is cleared periodically. It is used for diagnostic and aggregate statistics purposes only.

The table above is a summary of our practices at the time of writing, which may change over time within the bounds of our full privacy policy.

Privacy Policy

A privacy policy is an important foundation of our relationship, but we do believe trust is earned. Read on for more commentary like this in the margins.

This Privacy Policy was last revised on June 6, 2011. A history of changes to the privacy policy is given at the end.

Popvox, Inc. (“Popvox,” “we,” or “us”) knows that you care how information about you is used and shared. This Privacy Policy explains what information of yours will be collected by Popvox when you use the Popvox Service, how the information will be used, and how you can control the collection, correction and/or deletion of information. We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms of Use (see the corresponding tab on this page).

Information We Collect

User-Provided Information: You provide us information about yourself, such as your name, address, telephone number, and e-mail address if you register for an account with the Service. You may also provide us with your public comments on issues, messages to Members of Congress, and messages to other users of the website. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may retain any such User-Provided Information indefinitely, except as noted below.

Cookies Information: Cookies are small text files that websites store on users’ computers that are used to keep track of who is who, in the same manner that one draws a ticket number at a market or DMV to hold a place in line. Each time you return to a website, your web browser sends back the cookie (i.e. your ticket number) given to you by that website. At Popvox as elsewhere, cookies help you log in faster and enable easier navigation through the site. Popvox uses persistent cookies, meaning they remain indefinitely on users’ computers until the user logs out of their Popvox account or instructs their web browser to clear any saved cookies.

Log File Information: Log file information is automatically reported by your browser each time you access a web page. When you use the Service, our servers automatically record certain log file information. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, pages viewed, and other such information. We retain Log File Information for at most one year, after which point we will retain only aggregate statistics based on the Log File Information such as but not limited to site-wide monthly visit totals.

You might notice we removed the part about “non-obvious pingbacks”. After some feedback on it, we decided we wouldn’t do that.

Third Party Services: On your visit to Popvox your web browser may access resources from third-party services that we have engaged with, including analytics services which help us understand how our users are using the website and advertising services which deliver advertising directly to the user. These services may collect the same sorts of information as described above and their use of it is governed by their Privacy Policy.

How We Use Your Information

We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the Service.

We’re going to email you from time to time if you let us. You can change your email settings here.

By providing Popvox your email address, you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. You also agree that we may send you notifications of activity on the Service to the email address you give us, in accordance with any applicable privacy settings. We may use your email address to send you other messages, such as newsletters, changes to features of the Service, or special offers. If you do not want to receive such email messages, you may opt out or change your preferences in your account settings page. You may not opt out of some Service-related e-mails except by closing your Popvox account.

We delete as much as we can when you ask us to delete your account. But we need to keep some records for a period of time for everyone’s protection. If you wrote your Member of Congress, we keep records of what we’ve sent on your behalf so no one can claim otherwise.

Following termination or deactivation of your account, Popvox may retain your User-Provided Information for a commercially reasonable time as part of our backup and audit procedures. Furthermore, Popvox may retain and continue to use indefinitely all information (including User Content) contained in your communications to other Users or posted to public or semi-public areas of the Service after termination or deactivation of your Member account.

If you choose to use our invitation service to invite a friend to the Service, we will ask you for that person's email address and automatically send an email invitation. Popvox stores this information to send this email, to register your friend if your invitation is accepted, and to track the success of our invitation service. Your friend may contact us to request that we remove this information from our database at .

We use cookies, non-obvious pingbacks, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (e) diagnose or fix technology problems reported by our Users or engineers that are associated with certain IP addresses; (f) help you efficiently access your information after you sign in; and (h) and track User Content and Users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act.

How We Share Your Information

POPVOX is a lockbox. Your personal information stays with us and your Members of Congress.

Personally Identifiable Information: Popvox may share your personally identifiable information with third parties for the purpose of providing the Service to you. If we do this, such third parties’ use of your information will be bound by this Privacy Policy. We may store personal information in locations outside the direct control of Popvox (for instance, on servers or databases co-located with hosting providers). Popvox will not share, rent, or sell your personally identifiable information in any other manner except as stated when you enter the information, or if you opt-in to additional services. For instance, it is noted on the website that Popvox may allow Congressional staff to access your name and physical address if you reside in their Congressional district. Members of Congress are greatly restricted in what they can do with this information by Congressional rules and law. If you use Popvox to comment on legislation before Congress, your comment along with your username and the city and state of your address, as you provided, will be displayed publicly.

This is mainly just if POPVOX gets acquired by another company, and obviously in that case they will have all of the information we have. If we get acquired, our new parent company would be bound by these same terms anyway.

As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of the Service, or if other Users have copied or saved that information.

From time to time, we may run contests, special offers, or other events or activities (“Events”) on the Service together with a third party partner. If you provide information to such third parties, you give them permission to use it for the purpose of that Event and any other use that you approve. We cannot control third parties’ use of your information. If you do not want your information to be collected by or shared with a third party, you can choose not to participate in these Events.

Except as otherwise described in this Privacy Policy, Popvox will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Popvox, our Users or others.

Non-Personally Identifiable Information: We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for Popvox services.

We are leaving the possibility open of using a third-party ad service, although right now we run our advertising entirely in-house.

Popvox may allow third-party ad servers or ad networks to serve advertisements on the Service. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on Popvox. They automatically receive your IP address when this happens and may also use other technologies such as cookies to measure the effectiveness of their advertisements and to personalize the advertising content. Popvox does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks Popvox to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach. In addition, third-party advertisers may use information about your visits to this and other websites in order to provide advertisements about goods and services of interest to you, such as the addresses of the pages you visit. The Popvox Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers for more information.

How We Protect Your Information

Did you notice the https in all POPVOX page? That means your information is encrypted between your computer and our computers. That protects you even on insecure WiFi networks.

Popvox cares about the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Popvox or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Your privacy settings may also be affected by changes to the functionality of Popvox’s distributors, such as social networks. Popvox is not responsible for the functionality or security measures of any third party.

To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Popvox, at all times.

Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, Popvox will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Your Choices About Your Information

You may, of course, decline to submit personally identifiable information through the Service, in which case Popvox may not be able to provide certain services to you. You may update or correct your account information and email preferences at any time by logging in to your account and proceeding to your account settings page. You can review and correct the information about you that Popvox keeps on file by contacting us directly at .

Children's Privacy

Writing your Members of Congress is a great learning experience. But please have your children under the age of 13 do so through the account of an adult.

Protecting the privacy of young children is especially important. For that reason, Popvox does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on Popvox. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Links to Other Web Sites

We are not responsible for the practices employed by websites linked to or from the Service, nor the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website's own rules and policies. Please read over those rules and policies before proceeding.

Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on the Service, as determined by Popvox in its sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.

Changes to Our Privacy Policy

The changes we have made to this policy are listed below. When we make future changes that require your approval, we will let you know.

If we change our privacy policies and procedures, we will post those changes on the Service to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page.

Terms of Use Agreement

POPVOX is a soapbox to quantify and amplify your voice on matters before the U.S. Congress, but we have to lay down some ground rules. Read on for more commentary like this in the margins.

This Agreement was last revised on January 20, 2011.

Popvox.com is the website and online service of Popvox, Inc. (“Popvox,” “we,” or “us”). This page explains the terms by which you may use our online and mobile services and software provided on or in connection with the service (collectively the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”), whether or not you are a registered user of our Service.

We will let you know before we make any serious changes to these terms.

We reserve the right to amend this Agreement. If we substantively amend this Agreement and you are a registered user, we will give you at least seven (7) days notice before the changes take effect, during which period of time you may reject the changes by terminating your account. No notice shall be required for non-substantive changes to the Agreement. Your continued use of the Service after any such change constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the Service (“Users”).

1.Use of Our Service

A.Eligibility
Writing your Members of Congress is a great learning experience. But please have your children under the age of 13 do so through the account of an adult.

You may use the Service only if you can form a binding contract with Popvox, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the Service by anyone under 13 is strictly prohibited and in violation of this Agreement. The Service is not available to any Users previously removed from the Service by Popvox.

B.Popvox Accounts
If you register for an organization or as legislative staff, you must be authorized to do so by your organization or office.

You do not need to register for an account to visit Popvox, but registering for a Popvox account gives you access to certain additional functionality that we may establish and maintain from time to time and at our sole discretion. We may maintain different types of accounts for different types of Users. If you open a Popvox account for an organization or congressional legislative staff, or another type of account through which you will represent an organization, company, office for a Member of Congress, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity’s behalf. By logging in to Popvox with a third-party sign-in service such as an OAuth provider, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials and private profile information on that service.

Since we send messages on your behalf to Congress, we expect you to provide accurate information about yourself.

You may never use another User’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure (or if you use a third-party sign-in, keep your login credentials at the third-party service secure). We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. You must notify Popvox immediately of any unauthorized use of your account. Popvox will not be liable for any losses caused by any unauthorized use of your account.

By providing Popvox your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail, and updates to this agreement. We may also use your email address to send you other messages, such as changes to features of the Service, which, you may opt out of in your account settings page.

C.Service Rules
Don’t hack or spider us, obviously. Don’t lie. Create only one account for yourself.

You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”; (ii) using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service in a manner that sends more request messages to the Popvox servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that Popvox grants the operators of public search engines revocable permission to use spiders to copy materials from Popvox.com for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials); (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service; (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (vi) uploading invalid data, viruses, worms, or other executable code through the Service; (vii) collecting or harvesting any information from the Service, including account names, through which personally identifiable information can be learned; (viii) using the Service for any commercial solicitation purposes; (ix) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, misrepresenting your identity; (x) creating multiple accounts; or (xi) bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.

Accessing the audiovisual content available on the Service for any purpose or in any manner other than Streaming (as defined below) is expressly prohibited. “Streaming” means a contemporaneous digital transmission of an audiovisual work via the Internet from the Popvox Service to a User’s device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the User.

We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to users generally; or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement.

You are solely responsible for your interactions with other Popvox Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users. Popvox shall have no liability for your interactions with other Users, or for any User’s action or inaction.

2.User Content

You retain ownership of all of the content you post to POPVOX.

Some areas of the Service allow Users to post content, such as comments, profile information, and other content or information (any such materials a User submits, posts, displays, or otherwise makes available on the Service “User Content”). You retain ownership of your User Content.

This section is summarized in our Guidelines on Acceptable Language. POPVOX isn’t a free for all, but if you stick to a civil tone you should be all right.

Except to the extent that User Content expresses support or opposition for a matter on which Popvox is soliciting User opinions, you agree not to post User Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; (ii) may create a risk of any other loss or damage to any person or property. You agree not to post User Content that (i) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise; (ii) may constitute or contribute to a crime or tort; (iii) contains any information or content that we deem to be unlawful, abusive, harassing, or threatening to an individual, invasive of personal privacy rights, or profane; (iv) contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets); (v) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or (vi) contains any information or content that you know is not correct and current. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined below) or rights of privacy. Popvox reserves the right, but is not obligated, to reject and/or remove any User Content that Popvox believes, in its sole discretion, violates these provisions.

For the purposes of this Agreement, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction.

In connection with your User Content, you affirm, represent and warrant the following:

A. Your User Content and Popvox's use thereof as contemplated by this Agreement and the Service will not violate any law or infringe any rights of any third party, including but not limited to any Intellectual Property Rights and privacy rights.

B. Popvox may exercise the rights to your User Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise.

Popvox takes no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. You shall be solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose, and you agree that Popvox shall not be liable for any damages you allege to incur as a result of User Content.

3.User Content License Grant

Since you retain ownership of information you post to POPVOX, you’ll have to give us permission to use it. Here are those terms.

By posting any User Content on the Service, you expressly grant, and you represent and warrant that you have a right to grant, to Popvox a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Service.

Although we delete most information about you when you ask us to delete your account, this section takes our rights to your information away at that point.

If the features of the Service allow you to remove or delete User Content from the Service, the above licenses granted by you in your User Content terminate within a commercially reasonable time after you remove or delete such User Content from the Service. You understand and agree, however, that Popvox may retain, but not display, distribute, or perform, server copies of User Content that have been removed or deleted. The above licenses granted by you in User Content for which the Service does not provide you a means to delete or remove are perpetual and irrevocable.

4.End User License Grant

A. Popvox Service. Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service as permitted by the features of the Service. Popvox reserves all rights not expressly granted herein in the Service and the Popvox Content (as defined below). Popvox may terminate this license at any time for any reason or no reason.

B. Mobile Software. We may make available software to access the Service via a mobile device (“Mobile Software”). To use the Mobile Software you must have a mobile device that is compatible with the Mobile Service. Popvox does not warrant that the Mobile Software will be compatible with your mobile device. Popvox hereby grants you a non-exclusive, non-transferable, revocable license to use a compiled code copy of the Mobile Software for one Popvox account on one mobile device owned or leased solely by you, for your personal use.You may not: (i) modify, disassemble, decompile or reverse engineer the Mobile Software, except to the extent that such restriction is expressly prohibited by law; (ii) rent, lease, loan, resell, sublicense, distribute or otherwise transfer the Mobile Software to any third party or use the Mobile Software to provide time sharing or similar services for any third party; (iii) make any copies of the Mobile Software; (iv) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Mobile Software, features that prevent or restrict use or copying of any content accessible through the Mobile Software, or features that enforce limitations on use of the Mobile Software; or (v) delete the copyright and other proprietary rights notices on the Mobile Software. You acknowledge that Popvox may from time to time issue upgraded versions of the Mobile Software, and may automatically electronically upgrade the version of the Mobile Software that you are using on your mobile device. You consent to such automatic upgrading on your mobile device, and agree that the terms and conditions of this Agreement will apply to all such upgrades. Any third-party code that may be incorporated in the Mobile Software is covered by the applicable open source or third-party license EULA, if any, authorizing use of such code. The foregoing license grant is not a sale of the Mobile Software or any copy thereof, and Popvox or its third party partners or suppliers retain all right, title, and interest in the Mobile Software (and any copy thereof). Any attempt by you to transfer any of the rights, duties or obligations hereunder, except as expressly provided for in this Agreement, is void. Popvox reserves all rights not expressly granted under this Agreement. If the Mobile Software is being acquired on behalf of the United States Government, then the following provision applies. Use, duplication, or disclosure of the Mobile Software by the U.S. Government is subject to restrictions set forth in this Agreement and as provided in DFARS 227.7202-1(a) and 227.7202-3(a) (1995), DFARS 252.227-7013(c)(1)(ii) (OCT 1988), FAR 12.212(a) (1995), FAR 52.227-19, or FAR 52.227-14 (ALT III), as applicable. The Mobile Software originates in the United States, and is subject to United States export laws and regulations. The Mobile Software may not be exported or re-exported to certain countries or those persons or entities prohibited from receiving exports from the United States. In addition, the Mobile Software may be subject to the import and export laws of other countries. You agree to comply with all United States and foreign laws related to use of the Mobile Software and the Popvox Service.

(1) Mobile Software from iTunes. The following applies to any Mobile Software you acquire from the iTunes Store (“iTunes-Sourced Software”): You acknowledge and agree that this Agreement is solely between you and Popvox, not Apple, and that Apple has no responsibility for the iTunes-Sourced Software or content thereof. Your use of the iTunes-Sourced Software must comply with the App Store Terms of Service. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the iTunes-Sourced Software. In the event of any failure of the iTunes-Sourced Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the iTunes-Sourced Software to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iTunes-Sourced Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by this Agreement and any law applicable to Popvox as provider of the software. You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the iTunes-Sourced Software or your possession and/or use of the iTunes-Sourced Software, including, but not limited to: (i) product liability claims; (ii) any claim that the iTunes-Sourced Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation; and all such claims are governed solely by this Agreement and any law applicable to Popvox as provider of the software. You acknowledge that, in the event of any third party claim that the iTunes-Sourced Software or your possession and use of that iTunes-Sourced Software infringes that third party’s intellectual property rights, Popvox, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by this Agreement. You and Popvox acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement as relates to your license of the iTunes-Sourced Software, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement as relates to your license of the iTunes-Sourced Software against you as a third party beneficiary thereof.

5.Our Proprietary Rights

You retain ownership of information you post to POPVOX, and we retain ownership of . . . POPVOX.

Except for your User Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content (the "Popvox Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Popvox and its licensors. Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any materials or content accessible on the Service. Use of the Popvox Content or materials on the Service for any purpose not expressly permitted by this Agreement is strictly prohibited.

You don’t get anything by providing feedback to us.

You may choose to or we may invite you to submit comments or ideas about the Service, including without limitation about how to improve the Service or our products (“Ideas”). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Popvox under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Popvox does not waive any rights to use similar or related ideas previously known to Popvox, or developed by its employees, or obtained from sources other than you.

6.Paid Services

We have some paid services, mostly geared toward advocacy organizations. When we make changes to pricing, we will let you know in the billing cycle before they take effect.

A. Billing Policies. Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time. Popvox may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.

Sorry, no refunds!.

B. No Refunds. You may cancel Popvox paid services at any time; however, there are no refunds for cancellation. In the event that Popvox suspends or terminates your account or this Agreement for your misconduct, you understand and agree that you shall receive no refund for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your account, or for anything else.

You are responsible for all taxes.

C. Payment Information; Taxes. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by uses of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

7.Privacy.

By using the Service, you are consenting to have your personal data collected, used, transferred to and processed in the United States according to our Privacy Policy document, which is incorporated into this agreement.

8.Security

Popvox cares about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.

9.DMCA Notice

POPVOX’s CTO was inspired to get involved in government transparency because of the odd rules in the DMCA.

Since we respect content owner rights, it is Popvox’s policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 (“DMCA”).

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify Popvox’s copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner;

2. Identification of the copyrighted work that you claim has been infringed;

3. Identification of the material that is claimed to be infringing and where it is located on the Service;

You expressly relieve Popvox from any and all liability arising from your use of any third-party website, service, or content. Additionally, your dealings with or participation in promotions of advertisers found on the Service, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that Popvox shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.

11.Indemnity

You agree to defend, indemnify and hold harmless Popvox and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service, including any data or content transmitted or received by you; (ii) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (iv) your violation of any applicable law, rule or regulation; (v) any claim or damages that arise as a result of any of your User Content or any that is submitted via your account; or (vi) any other party’s access and use of the Service with your unique username, password or other appropriate security code.

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF POPVOX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

The Service is controlled and operated from its facilities in the United States. Popvox makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable United States and local laws and regulations, including but not limited to export and import regulations. You may not use the Service if you are a resident of a country embargoed by the United States, or are a foreign person or entity blocked or denied by the United States government. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals, companies, or other entities located in the United States.

14.Assignment

This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Popvox without restriction.

15.General

A. Governing Law. You agree that: (i) the Service shall be deemed solely based in California; and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over Popvox, either specific or general, in jurisdictions other than California. This Agreement shall be governed by the internal substantive laws of the State of California, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any claim or dispute between you and Popvox that arises in whole or in part from the Service shall be decided exclusively by a court of competent jurisdiction located in Santa Clara County, California, unless submitted to arbitration as set forth in the following paragraph.

B. Arbitration. For any claim (excluding claims for injunctive or other equitable relief) under this Agreement where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute through binding non-appearance-based arbitration. The party electing such arbitration shall initiate the arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, as selected by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

C. Notification Procedures. Popvox may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on our website, as determined by Popvox in our sole discretion. Popvox reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt out of certain means of notification as described in this Agreement. Popvox is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us.

D. Entire Agreement/Severability. This Agreement, together with any amendments and any additional agreements you may enter into with Popvox in connection with the Service, shall constitute the entire agreement between you and Popvox concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

E. No Waiver. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Popvox’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. Do Not Track Compliance

What is Do Not Track?

“Do Not Track” (DNT) is a new approach to allowing web users the ability to state their preference to opt-out of being tracked by services they may not be aware are collecting data about them. Although there is no one adopted standard for how web sites are supposed to behave in order to be Do Not Track-compliant, POPVOX has taken some steps outlined here to get ahead of the game.

As of June 2011, Firefox version 4, Safari version 5.1, and Internet Explorer version 9 support the Do Not Track user preference.

Do Not Track is primarily aimed at the tracking that large advertising networks do to shape the advertisements they show you. One confusing aspect of Do Not Track is that it does not actually apply to the websites you visit directly. Instead, Do Not Track is intended solely to stop companies that you don’t know even have your information from tracking you.

In other words, when you visit xyz.com directly the Do Not Track standard(s) are not applicable to xyz.com. The idea is that since you know you are visiting xyz.com, you can choose to accept their privacy policy. But if xyz.com embeds advertising from zyx.com, you don’t have an opportunity to evaluate zyx's policy. If you are using a supported web browser with Do Not Track turned on, zyx.com is Do Not Track compliant only if it does not track you from session to session.

“DNT” When You Visit POPVOX.com

When you visit POPVOX.com directly the Do Not Track standard(s) are not relevant — see the explanation above. Instead, see our Privacy Report and Privacy Policy.

Even so, we take the extra step of embedding only DNT-compliant third-party resources on POPVOX when you have turned on your browser’s DNT option. That means that when you visit POPVOX.com, your DNT preference will be respected by us and any other web content loaded on our site by your browser. At the time of writing, we are embedding the following services:

We consider these to fall under the "exclusively on behalf of and for the use of a first party" type of allowed tracking. When your DNT option is turned on, we disable the following other resources that we normally embed:

  • Google Maps: Because the Google Maps API is probably not DNT compliant, we disable this part of POPVOX when your DNT option is turned on. We use Google Maps in a small number of cases to help find your Congressional district when we cannot find it based on your street address.
  • Facebook Facepiles
  • HubSpot

Unfortunately because of our use of Google Maps, this may mean you may not be able to use POPVOX properly with the DNT option turned on.

“DNT” When You Encounter a POPVOX Widget

We provide a number of widgets that blogs and advocacy websites can embed to show information from POPVOX. We generally use the same privacy standards whether or not the user is using a DNT-supported web browser or have the DNT option on.

Most of our widgets do not get or set cookies and only record what are called protocol logs for security and fraud protection. These widgets are DNT-compliant.

Our Write Congress widget is our only widget that uses cookies, which it does in order to provide the user the convenience of not entering in their name and address when we already have that information. We plan to turn off that functionality when the user has set the DNT preference on, which will soon make the widget DNT-compliant.
