A BILL

To provide for the conveyance of a small parcel of National Forest System land in the Uinta-Wasatch-Cache National Forest in Utah to Brigham Young University, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ``Y Mountain Access Enhancement Act''.

SEC. 2. LAND CONVEYANCE, UINTA-WASATCH-CACHE NATIONAL FOREST, UTAH.

(a) Conveyance Required.--On the request of Brigham Young University submitted to the Secretary of Agriculture not later than one year after the date of the enactment of this Act, the Secretary shall convey, not later than one year after receiving the request, to Brigham Young University all right, title, and interest of the United States in and to an approximately 80-acre parcel of National Forest System land in the Uinta-Wasatch-Cache National Forest in the State of Utah consisting of SE\1/4\SE\1/4\ of Section 32, T. 6 S., R. 3 E., and lot 4 of Section 5, T. 7 S., R. 3 E., Salt Lake Base & Meridian. The conveyance shall be subject to valid existing rights and shall be made by quitclaim deed. (b) Consideration.-- (1) Consideration required.--As consideration for the land conveyed under subsection (a), Brigham Young University shall pay to the Secretary an amount equal to the fair market value of the land, as determined by an appraisal approved by the Secretary and conducted in conformity with the Uniform Appraisal Standards for Federal Land Acquisitions and...

I support S. 28: Y Mountain Access Enhancement Act because..the land is an 80-acre parcel for which Brigham Young University shall pay fair market value determined by appraisal approved by Secretary of Agriculture. The monies received "shall be deposited in the general fund of the Treasury to reduce the Federal deficit." BYU's signature "Y" is partly on BYU land. The purchase would allow the "Y" to be totally on BYU land and would allow BYU to maintain the trail, which currently is maintained for the Forest Service by volunteers. The University would be able to provide uniform maintenance to the whole property and is financially more able to do so than the Forest Service. The Bill states that BYU would assure the "same reasonable public access to the portion of the Y Mountain Trail and the 'Y' symbol located on the land..." Please vote "Yes" on S. 28: Y Mountain Access Enhancement Act. Thank you.

1/22/2013--Introduced.Y Mountain Access Enhancement Act - Directs the Secretary of Agriculture (USDA), upon request by Brigham Young University, to convey an approximately 80-acre parcel of National Forest System land in the Uinta-Wasatch-Cache National Forest in Utah. Requires the University to pay to the Secretary an amount equal to the fair market value of such land. Requires such consideration to be deposited in the general Treasury fund to reduce the federal deficit. Directs the University, after the conveyance, to represent that it will: (1) continue allowing the same reasonable public access to the trailhead, and the part of the Y Mountain Trail already owned by the University, as has been historically allowed; and (2) allow such access to the part of the Trail and the "Y" symbol located on the conveyed land.
